Introduction

SKA Digital LLC ("SKA Digital," "we," "us," or "our") operates MarketSim, a marketing simulation platform for higher education, accessible at modernsims.com (the "Site"). We are committed to protecting your privacy and being transparent about how we collect, use, and share your information.

This Privacy Policy applies to information collected through the Site. By using the Site, you agree to the practices described in this policy. This policy does not apply to third-party websites or services linked from the Site.

1. Information We Collect

Information You Provide

  • Account information: Full name, email address, and password when you create an account.
  • Role information: Whether you are a student or instructor.
  • Simulation content: Team names, brand names, marketing decisions, strategies, and other content you create within the Platform.
  • Payment information: Billing details processed through Stripe. We do not store your credit card number, expiration date, or CVV on our servers.
  • Communications: Any messages or inquiries you send to us via email.

Information Collected Automatically

  • Usage data: Pages visited, features used, actions taken within the Platform, and timestamps.
  • Device data: Browser type, operating system, IP address, and general location (city/region level).
  • Cookies: We use essential cookies only, primarily for authentication (Supabase session tokens). We do not use advertising or tracking cookies.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Platform;
  • Process payments and manage your account;
  • Enable instructors to manage simulations, teams, and view student performance;
  • Communicate with you about your account, support requests, and service updates;
  • Improve the Platform through aggregated, anonymized usage analytics;
  • Enforce our Terms of Use and protect against fraud or abuse.

3. How We Share Your Information

We do not sell, rent, or trade your personal information. We share information only in the following circumstances:

  • With your instructor: Instructors can view student names, team assignments, decisions, and simulation results for their courses.
  • With teammates: Other members of your team can see your name and shared simulation data.
  • With service providers: We use the following third-party services to operate the Platform:
    • Supabase — Authentication and database hosting (data encrypted at rest with AES-256)
    • Vercel — Application hosting and delivery (HTTPS enforced)
    • Stripe — Payment processing (PCI DSS compliant; we never handle card data directly)
  • As required by law: We may disclose information in response to valid legal requests, subpoenas, court orders, or to protect our rights and the safety of others.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

4. Student Data and FERPA

We recognize the importance of student data privacy. When the Platform is used as part of a course at an educational institution:

  • We act as a "school official" with legitimate educational interest under FERPA;
  • We do not use student data for advertising, marketing profiles, or any commercial purpose unrelated to the Platform;
  • We do not sell student data to any third party;
  • We will enter into a Data Processing Agreement (DPA) with educational institutions upon request.

5. Data Retention

  • Active accounts: We retain your information for as long as your account is active or as needed to provide services.
  • After course completion: Simulation data is retained for up to 2 years after the last activity to allow for grade disputes and academic review.
  • Deletion: You may request deletion of your account and associated data at any time by contacting us. We will process deletion requests within 30 days.
  • Anonymized data: We may retain aggregated, anonymized data indefinitely for product improvement.

6. Data Security

We take reasonable measures to protect your information, including:

  • HTTPS encryption on all connections (enforced by Vercel);
  • Encryption at rest for all database records (AES-256 via Supabase/AWS);
  • Row-Level Security (RLS) policies ensuring users can only access their own data;
  • Secure authentication with hashed passwords (managed by Supabase Auth).

No system is perfectly secure. If we discover a data breach affecting your personal information, we will notify you and relevant authorities within 72 hours as required by law.

7. Your Rights

Depending on your location, you may have the right to:

  • Access: Request a copy of the personal data we hold about you;
  • Correction: Request correction of inaccurate data;
  • Deletion: Request deletion of your personal data;
  • Portability: Request your data in a machine-readable format;
  • Objection: Object to certain processing of your data.

8. Cookies

We use only essential cookies required for the Platform to function (authentication session tokens). We do not use advertising cookies, tracking pixels, or third-party analytics cookies. You can disable cookies in your browser settings, but this may prevent you from using the Platform.

9. Children's Privacy

The Platform is intended for users who are 18 years of age or older. We do not knowingly collect personal information from individuals under 18. If we become aware that we have collected such information, we will promptly delete it.

10. International Users

The Platform is operated from the United States. If you access the Site from outside the U.S., your information will be transferred to and processed in the U.S. By using the Site, you consent to this transfer.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify users of material changes by posting the updated policy on the Site with a revised date. Your continued use of the Platform after changes are posted constitutes acceptance.
